Sewage Treatment System Code Compliance
Minnesota is the Land of 10,000 Lakes. We must all work together to protect our beautiful lakes and rivers. Rural communities all around the state rely on Individual Sewage Treatment Systems (ISTS) to make human waste safe for the environment. There are MN statewide and local codes and regulations on what is needed for reliable sewage treatment. Licensed Septic Inspectors conduct Septic Compliance Inspections to evaluate individual sewer systems for code compliance. Brad Krotzer of Custom Septic Inc. After completion of the compliance inspection, you will be given either a Certificate of Compliance (COC) or a Notice of Non-Compliance (NON).
MN Certificate of Compliance (COC)
Simply put, a Certificate of Compliance (COC) lets you know that your Individual Sewage Treatment System (ISTS) is code compliant at the time of inspection. However, receiving a COC doesn’t guarantee system performance if there is a change in wastewater usage. A Certificate of Compliance is valid for 3 years on an existing ISTS.
MN Notice of Non Compliance (NON)
Receiving a Notice of Non Compliance (NON) means that your septic system has failed to be compliant with Minnesota state or local government regulations. It depends on the type of NON that you receive for just what this means.
If your sewage treatment system is tagged as NON and has been designated as an Imminent Threat to Public Health of Safety, you will be told how much time you have to Upgrade, Replace or Repair the failing septic system.
The other designation as NON is considered Failing to Protect Ground Water. This is a less serious problem but still must be taken care of and brought up to code within the mandated time frame. Ten months to be in compliance is a fairly common time period across MN.
Reasons For Septic Compliance Inspection
Currently, the State of Minnesota does not require a Septic Compliance Inspection when property changes ownership. However, many local governments have regulations requiring an inspection at property transfer. Your local City, Township, County, Realtor or Mortgage Lender may require that you have a Sewage Treatment System inspected under the following circumstances:
- If there has been a Sewage Spill
- When there has been a Complaint
- As part of a local land or water Survey
- If required before Closing on a property
- When stipulated before approval of Mortgage Financing
